For families, the sudden and unexpected loss of a loved one, often caused by a motor vehicle accident or medical negligence, can have an overwhelming emotional impact. Many of those who live through such a loss will have their grief quickly compounded by practical concerns about finances and carrying on with family life. The lawyers at Mann Lawyers guide Ottawa and Eastern Ontario families through their legal options following a fatal accident or medical treatment.

Taking the legal steps toward security

For many, a fatal accident results in the loss of not only a beloved individual but also one of the family’s main sources of income. In Ontario, it is possible to take legal steps to be compensated for this loss, by filing a lawsuit against the person who caused the death. If the loss was the result of a fatal car accident, truck accident or motorcycle crash, some immediate compensation will be available as a no-fault benefit from the deceased’s own auto insurance.

Many factors contribute to the assessment of damages in a fatal accident claim. The team at Mann Lawyers works with the appropriate experts to determine the full value of the financial support that the loved one would have provided to the rest of the family, taking into account the individual’s occupation and life path. While no amount of money can ever compensate for the loss of a family member, a successful legal claim will ensure financial stability while the family rebuilds.

Frequently Asked Questions

How easy is it to hold a negligent party accountable for a fatal accident?

This depends on the amount of evidence and supporting documentation you have confirming a party’s role in the tragedy at hand. The more evidence you have, the stronger we can build your case. While we respect this can be a difficult and trying time, it is critical to gather any available evidence that will improve your chances of an appropriate resolution.

How do I know if I can claim compensation?

According to section 61 of the Ontario’s Family Act, R.S.O. 1990, cF.3 the following individuals related to the deceased are eligible for compensation:

  • Spouse / common-law spouse
  • Children and grandchildren
  • Parents
  • Grandparents
  • Siblings

What can be compensated for after a fatal accident?

At Mann Lawyers, we believe that fatal accidents deserve fair and appropriate compensation. While a loved one can never be replaced, maintaining financial stability and having sufficient legal support can make the coping process a little bit easier to handle during such a difficult time. There are a variety of claims associated with losing a loved one, and not all of them are strictly financial. For instance, a grieving spouse will obviously be unable to perform work-related duties while they attempt to cope, leading to emotional distress combined with a loss of income. In addition, the guidance and companionship of the deceased represents a loss of care and support for their family. The same applies to earnings, which can effectively be halved if not more when considering a marriage with shared income. There are also funeral and burial expenses to consider in addition to out-of-pocket costs associated with travel, housekeeping services and more.

When do I need to file a fatal accident claim?

Please be aware that there is a time limit for filing your claim, usually within two years of the loss. However, contact us sooner, if you believe the death of a loved one was caused by the negligence of others. This will give us time to gather sufficient evidence, which will be used to strengthen your case and increase the likelihood of an appropriate settlement.

  • A couple of years ago my life changed as a result of a slip and fall.  I sustained some serious side effects that have continued to negatively affect my quality of life.  As a lay person, suffering with a concussion, it can be very daunting to navigate the legal system.  Thankfully, I was advised to seek out Mann Lawyers and specifically you (Karine Devost), as my legal counsel.  That was probably the best advice I have ever received.  Karine, you are intelligent, empathetic and you really "listen".  You and your team's professionalism and commitment for a fair settlement went far beyond my expectations.   I want to thank you so very much for your kindness and your dedication.  I will be forever grateful to you for making my life better.  It is because of you that I received a fair and reasonable settlement without going to court.

  • Mr. Cantor helped me settle both my Accident Benefits and Torts claims. Throughout the process he was always my strongest advocate and fought for me even when I was not strong enough to fight for myself. Mr. Cantor, and his Legal Assistant Julie were always there for questions or support. He was able to put together a team that helped me get back to work and normal functions of everyday life post-accident. I was very satisfied with my final compensation and highly recommend Mr. Cantor for his professional, supportive and compassionate services.

  • I was referred to Kevin Cantor, from Mann Lawyers, after the death of my brother in 2016. After explaining what had happened, Kevin agreed that we had grounds for a medical malpractice suit. Kevin was excellent, explaining what would happen if we went ahead with the suit and what to expect from the defendants lawyers. Kevin was always prepared for court and I never lost confidence in his ability to help me when I needed it the most. Kevin and his secretary Julie both did an awesome job. This was a long process and as the case progressed, Kevin showed complete professionalism, and caring. Kevin was successful and I was awarded a sizable settlement. I would highly recommend Kevin to anyone facing the challenge of losing a loved one due to malpractice and negligence.
